Service of the lawsuit of the company Port Lotniczy Poznań - Ławica Sp. z o.o. on the Company.

ATREM S.A. with its registered office in Bydgoszcz _hereinafter referred to as the "Company"_ in reference to the current report no. RB 30/2023 dated November 24, 2023. informs that yesterday, i.e. 13 March 2024r. The Company received from Port Lotniczy Poznań - Ławica Sp. z o. o. with its registered office in Poznań _hereinafter referred to as the Principal_ a statement of claim for payment of PLN 13,314,909.90 _in words: thirteen million three hundred and fourteen thousand nine hundred and nine zlotys 90/100_ for contractual penalties charged to the Company, according to the Principal, for inadequate performance of obligations during the guarantee and warranty period under the agreement of 10 April 2015, for the execution of the contract entitled: "Design, supply and delivery of the project".: "Design, supply and implementation of the integrated security system of Poznań Airport - Ławica and replacement of a fragment of the Airport fence" _further referred to as the Agreement_. The Ordering Party calculated the contractual penalties as the product of 0.1% of the value of the Company's remuneration under the Agreement in the total amount of PLN 6,728,100.00 _in words: six million, seven hundred and twenty-eight thousand and one hundred zloty 00/100_ gross for each day of delay and the number of days in default in removing several dozen errors and failures in the subject of the Agreement.

The Management Board of the Company is of the opinion that it duly performed its obligations under the Agreement during the guarantee and warranty period, thus in its reply to the statement of claim it requested that the claim be dismissed in its entirety, recognising the Ordering Party's claims as completely unfounded.

In the statement of claim, the Ordering Party requested that the case be referred to mediation proceedings. In its response to the statement of claim, the Company will agree to conduct mediation proceedings.
